Probate vs. Administrative Estates

Whether an estate goes through probate or is handled as an administrative estate depends solely on whether or not the decedent had a valid will. While in either case the object is to collect the property of the estate, identify beneficiaries and creditors, pay the debts of the estate, and distribute property, how this is accomplished is very different.

  • Probate - When a will exists, the assets of an estate will be distributed according the provisions of the will. In many cases, community property agreements can allow for the transfer of property between a wife and a husband without it going through the probate process. The probate of an estate can often be accomplished by the estate representative (or executor) with little court supervision.
  • Administrative Estates - When a person dies without a valid will, the court provides greater oversight on the estate administration process. The assets of the estate are distributed under a specific formula set out in Washington's laws of descent and distribution.
